Terms and Conditions
Dated: June 2019
These terms and conditions apply when you buy something from us. We’re going to
ask you to agree to these terms before you make a purchase, so please read them
carefully and make sure you understand them before ordering from our site. If you do
not accept these terms, we won’t be able to process your order (sorry, that’s just the
way it is).
Every now and then we amend these terms and the date at the top of the page will
tell you the last time they were updated. Every time you order products from us, the
terms in force at the time of your order will apply.
Depixym is a trading name of Project Cuttlefish Ltd, a registered company.
Throughout these Terms and Conditions any reference to Depixym means also it’s
parent company, Project Cuttlefish Ltd.
Product Descriptions, Images & Shade Swatches
All products shown on this website are for illustrative purposes only and available
only whilst stocks last. Although we have made every effort to reflect product colours
as accurately as possible, we are unable to guarantee that your computer’s display
of the them accurately reflects the true colour of the products.
All descriptions, specifications, images, drawings and advertising issued on this
website along with any descriptions, photos or illustrations in any promotional
material are issued or published for the sole purpose of giving an approximate idea
of the products described in them and they don’t form part of the contract with you.
Purchasing Products
You can purchase our products through our website using our online checkout
process.
Our Shop Now page will guide you through the steps you need to take to place an
order with us through our website. Our order process allows you to check and
amend your order before submitting it to us. Please make sure your order’s correct
at each stage of the process.
Once you place an order, you’ll get an e-mail from us acknowledging that we have
received your order. However, please note that this does not mean that your order
has been accepted by us and we reserve the right at all times and at our sole
discretion to refuse to accept any orders. We will confirm our acceptance to you by
sending you an e-mail to say that the products have shipped and are on their way.
The contract between us will only be formed when we send you this shipping
confirmation.

If we are unable to supply you with a product, we will inform you by e-mail and we
will not process your order.
Product Prices
All our prices are in £GBP. This is the only currency we are currently able to transact
in and as such all purchases will be processed using £GBP only. Prices for our
products may change from time to time, but changes will not affect any order you
have already placed.
Should you be placing an order from an account using a different currency, any rates
of conversion are to be agreed between you and your bank or payment service
provider and neither DEPIXYM nor it’s parent company Project Cuttlefish, can be
held responsible for any variances in cost due to currency conversion.
Prices shown in £GBP include VAT at 20% and are subject to change if the
applicable rate of VAT changes before your order is accepted
Unfortunately we are unable to ship products outside of the UK at this time.
All prices shown exclude shipping costs, which will be made clear during the
checkout process. To see what our delivery charges are, please refer to our
Shipping Questions page.
Despite our best efforts, it is possible that some of the products on our site may be
incorrectly priced. If we discover an error in the price of the products you have
ordered we will contact you to let you know. You then have the option of continuing
with the purchase at the correct price or cancelling your order. We won’t process
your order until we know what you want to do and if we can’t get hold of you using
the details you provided during the order process, we’ll treat the order as cancelled
and let you know in writing. Please note that if the pricing error is obvious and
unmistakeable and could have reasonably been recognised by you as a mispricing,
we do not have to provide the products to you at the incorrect (lower) price.
Your payment shall not be deemed to have been received by us until we have
received payment in cleared funds.
If you exercise a right to cancel your order but the products have already been
dispatched, please follow the Returns Procedure set out below Returns and
Exchanges.
How to Pay
You can only pay for products using a debit card, credit card, PayPal or Apple Pay.
Please refer to our Payments Method FAQ for the debit and credit cards we accept.
Payment for the products and all applicable delivery charges will be taken at the time
of ordering.
Shipping & Delivery

Any date or period for delivery shall be considered as indicative only. It is our policy
to try to despatch all orders within 3 working days. Any products not available at the
time of your order will be sent to you, as soon as possible, when received from the
supplier. In any case, delivery will be made within 30 days after the date we accept
your order.
If there are delays in the delivery caused by the carrier or any other third party then
we will contact you as soon as possible to let you know and, provided we do this, we
will not be liable for such delay. If there is a substantial delay you may cancel your
order by contacting us at contact@depixym.com and will be entitled to receive a
refund for any products you have paid for but not received.
Please note that we do not ship to PO Boxes.
If an incorrect destination country is selected during the checkout process, or the
address entered doesn’t correspond to the country selected, we will cancel your
order and notify you by e-mail. In the interest of security, we reserve the right to
despatch the product(s) purchased on this site to the billing address belonging to the
credit card used as payment and not to the nominated delivery address supplied by
you.
You may need to ensure somebody is available to sign for receipt of the products at
the delivery address. If there is nobody at the delivery address to take delivery and
sign for the products, you can contact the courier to arrange a new delivery time. We
cannot be responsible for any delivery problems arising from incomplete or incorrect
address details supplied by you.
Passing of Risk
Delivery of an order shall be completed when we deliver the products to the address
detailed in your order and the products will be your responsibility from that time. You
own the products once we have received payment in full, including all applicable
delivery charges. If you prevent delivery of the products by, for example, failing to
supply the courier or your local customs, tax office with necessary information or
documentation, or failing to pay local customs, taxes or courier’s administration fees
so your package is returned to DEPIXYM, any resulting return postage or courier’s
administration fees incurred will be deducted from the amount refunded to you in
respect of that order.
In the event of an order being lost by a third party which has either been authorised
by you to accept the products or a courier commissioned by you to deliver the
products, Depixym bears no risk once it has been delivered to them. Where goods
have been received damaged, a full refund will be made if we are notified of the
problem within 14 days of delivery by phone, email or otherwise in writing. You will
then be required to return the goods together with their original packaging to the
Depixym Customer Service address below
Where the goods are signed for, the customer bears the risk once the goods are
signed for (provided they are signed for by the customer or a person identified as
authorised by you). If a customer believes that a parcel has been tampered with, it is

their responsibility to refuse to sign for the goods (for the avoidance of doubt,
signature for the parcel does not affect your rights of return under clause 10).
Title and Defects
The Products shall be owned by you once we have received payment in full for the
Products. You need to inspect the products within a reasonable time after their
receipt. The Consumer Rights Act 2015 says products must be as described, fit for
purpose and of satisfactory quality. Let us know in writing or by email if the goods
are faulty or misdescribed and you will be entitled to a full refund, to get the product
repaired or replaced or to get some of their money back (please see clause 10
below).
Returns and Exchanges
If you’re not absolutely happy with your purchase, we will refund any unopened
products at any time during the period from our despatch confirmation to the end of
14 days after the day on which you receive the products. This does not affect your
statutory rights.
To request a refund, simply email us at contact@depixym.com and we’ll get things
processed for you.
Please note any products bought directly through our website Depixym.com can only
be returned to us. You can not return any item bought through this website to any
store carrying our products.
Any product bought from a store, can not be returned to us directly. Should you need
to request a refund for any reason you will need to return the product to the store
from which you made the purchase in line with their own Returns and Exchanges
policy.
Your Right to Cancel
If you cancel your order from us within this period by contacting us at
contact@depixym.com, we will refund you the price you paid for the products (once
we receive them at the Depixym Customer Service address below) excluding the
shipping costs provided they are unopened and in their original condition.
If a Product has been delivered to you before you decide to cancel your order, you
must also notify us at contact@depixym.com, referencing your order number and
returning the product to us without undue delay and in any event not later than 14
days after the day on which you let us know that you wish to cancel your order.
If you wish to return the products to us because they are faulty or mis-described,
again please contact us at contact@depixym.com in the first instance and we will
refund the price of the products in full, together with any applicable delivery charges.
As a consumer, you have legal rights in relation to products that are faulty or not as
described, and these legal rights are not affected by your right of return and refund in

these terms. Advice about your legal rights is available from your local Citizens’
Advice Bureau or Trading Standards office.
Refund Method
Any refund will be made in the same way as your original payment method. Please
contact us at contact@depixym.com to process this.
If the products are faulty, please return the products to us via tracked and signed for
first class post. Please include the proof of shipping and payment of shipping costs in
the shipment (or send to us separately via email referencing your order number) and
we will refund both the cost of the products and the shipping to you via your original
payment method.
If the products are not faulty, please also return the products to us via a safe and
reliable method, however the cost of return shipping will need to be borne by you.
We would suggest you use a tracked service as we can not be held liable for any
returned products which we do not receive.
Exchanges
We do not offer exchanges at this time.
Return of Products
You must return the products to us. We are unable to arrange collections at this
time. In order to process any refunds, unless the products are faulty they must be
returned unopened, in their original packaging (including the shipping packaging).
Please note that you are responsible for the products while they are in your
possession. We recommend that you wrap your products safely and securely to
avoid damage in transit back to us. You will need to send your products back to
“DEPIXYM, Project Cuttlefish Ltd, 6 David Lane, Nottingham, NG6 0JU”.
Limitation of Liability
If we fail to comply with these terms, we are responsible for loss or damage you
suffer that is a foreseeable result of our breach of these Terms or our negligence, but
we are not responsible for any loss or damage that is not foreseeable. Loss or
damage is foreseeable if it is an obvious consequence of our breach or if it was
contemplated by you and us at the time we entered into this contract.
We only supply the Products for domestic and private use. You agree not to use the
product for any commercial, business or resale purposes, and we have no liability to
you for any loss of profit, loss of business, business interruption, or loss of business
opportunity.
We do not in any way exclude or limit our liability for, death or personal injury caused
by our negligence, fraud or fraudulent misrepresentation, any breach of the terms

implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession), any
breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979
(description, satisfactory quality, fitness for purpose and samples) and defective
products under the Consumer Protection Act 1987.
We will not be liable or responsible for any failure to perform, or delay in
performance of, any of our obligations caused by any act or event beyond our
reasonable control (including without limitation, flood, drought, earthquake or other
natural disaster, fire, explosion or accident, labour or trade disputes or strikes, non-
performance by suppliers or subcontractors or interruption or failure of a utility
service). We will contact you as soon as reasonably possible to notify you if any of
our obligations will be suspended or delayed, and please refer to the Delivery section
above.
Complaints Procedure and Notices
We hope you’ve had a great experience with us, but just in case you haven’t please
let us know and we’ll get to work on making it better! So let us know everything, tell

As we are a young start up we don’t currently have a dedicated customer service
telephone number, but we’re working on it and hope to have one soon. In the
meantime please drop us an email and we’ll get back to you pretty darn fast.
Any notice, which we are required to give to you regarding the services, may be sent
by e-mail or first class-post to the address provided by you during your order process
or your address you have registered with us from time to time.
Unless otherwise explicitly stated, notices to us must be sent by registered mail or by
email to the address above.
Notices sent by e-mail are deemed to be received 24 hours after an e-mail is sent
unless we receive a notification that the e-mail address is invalid. Registered mail
and first class-post will be deemed received 3 days following the date of mailing.
Onward Sale
Products purchased from Depixym are not for re-sale or distribution. Depixym can at
its sole discretion restrict the quantity of any individual products available on any one

order and reserve the right to cancel any orders which are suspected are being
purchased for re-sale or distribution.
Electronic Transmissions
Depixym will take all reasonable care in accordance with applicable laws, in so far as
it is in its power to do so, to keep the details of the Customer’s Order and payment
secure, but in the absence of negligence on its part (and, subject to applicable laws,
including laws relating to data protection and privacy) Depixym, cannot be held liable
for any loss suffered by you if a third party procures unauthorised access to any data
you provide when accessing or ordering from the Online Store.
Unfortunately, the transmission of information via the internet is not completely
secure. Although we will do our best to protect your personal data, we cannot
guarantee the security of your data transmitted to the Online Store; any transmission
is at your own risk. Once we have received your information, we will use strict
procedures and security features to try to prevent unauthorised access.
Website Ownership
Our Website Depixym.com and all content (including but not exclusive to graphics,
texts, icons, buttons, videos, audio and other files, images, designs, texts, trade-
marks, brand names, software and other materials (collectively, the “Website
Content”)) that have been provided by Depixym and/or other individuals or entities.
All such Website Content is owned by Depixym, it’s parent company Project
Cuttlefish and/or any applicable third party. You hereby acknowledge that our
Website and the Website Content are protected to the fullest extent permitted by
applicable law – including, but not limited to, copyright, trade-mark, patent and all
other applicable laws. Your use of our Website and/or any Website Content does not
grant or transfer to you any ownership or other rights in the Website or any
component of the Website (including, without limitation, the Website Content), and
except as expressly provided, nothing herein or within a Website or any component
of a Website (including, without limitation, the Website Content) shall be construed
as conferring on you or any other person or entity any license under any of Depixym,
Project Cuttlefish or any third party’s intellectual property or other rights. Any rights
not expressly granted to you in this Agreement are expressly reserved by Depixym.
You may not modify, reproduce, distribute, create derivative works or adaptations of,
publicly display or in any way exploit this Website, any component of it, or any of the
Website Content, in whole or in part, except as expressly authorized by us. For
greater certainty and the avoidance of any doubt, you agree that you will not take
any action that is inconsistent with Depixym’s ownership of a Website and/or
Depixym’s ownership of, or any third party’s ownership of, any Website Content. You
are hereby expressly prohibited from removing any proprietary notice of Depixym, or
any third party, from any copy of a Website or any component of the Website
(including, without limitation, the Website Content).

General
These terms set out the entire understanding and agreement between you and us in
relation to your purchase of products from us. No other person shall have any right to
enforce these terms.
Nothing in these terms shall create or imply any agency, partnership, joint venture,
employee-employer or franchisor-franchisee relationship between you and us.
Headings are for reference purposes only and in no way define, limit, construe or
describe the scope or extent of the provisions to which they relate.
If any provision in these terms is held to be invalid or unenforceable, such provision
shall be struck out and the rest of the terms shall remain in full force and effect.
You may only transfer your rights or your obligations under these terms to another
person if we agree in writing.
Our failure to act with respect to a breach by you or others shall not be considered
as a waiver of our right to act with respect to subsequent or similar breaches.
Governing Law
These terms and any dispute or claim arising out of or in connection with them or
their subject matter or formation (including non-contractual disputes or claims) are
governed by and construed in accordance with English law and you agree that the
English courts will have exclusive jurisdiction for any dispute under this agreement.
